Terms of Service

These terms govern your use of the Hasp software, this website, and the relay we operate. By using any of them you agree to what follows.

Who these terms are with

Hasp is a product of Sanct OÜ, a private limited company registered in Estonia (“Sanct”, “we”, “us”). They form an agreement between you and Sanct OÜ. If you use Hasp on behalf of an organisation, you confirm you are allowed to accept these terms for it.

The software and your licence

Hasp is open source software released under the GNU Affero General Public License, version 3 (AGPL-3.0). Your rights to use, copy, modify, and distribute the software are governed by that licence, and where it conflicts with these terms for the software itself, the licence controls. These terms cover your use of the website and the relay we operate, and any use of the Hasp name and brand.

Acceptable use

You agree not to use Hasp or the relay to break the law, to infringe other people’s rights, or to disrupt, overload, or attack the service or the networks behind it. You are responsible for the data you sync and for keeping your devices and encryption keys safe.

Your keys and your data

Hasp is end to end encrypted, and the keys live only on your machines. We have no copy of them and no way to recover your data if you lose them. Keeping backups of your keys and your files is your responsibility.

The relay service

We may run a relay that helps your devices reach each other. It is provided as a convenience, free of charge, with no guaranteed uptime, and we may change, limit, or stop it at any time. The relay only ever handles sealed data, never your files in readable form, and you can run your own relay instead.

Brand and trademarks

The Hasp and Sanct names, logos, and brand belong to Sanct OÜ. The open source licence covers the software, not our trademarks, so please do not use them in a way that suggests we endorse or are behind something we are not.

No warranty

The software, the website, and the relay are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not promise the service will be uninterrupted or error free.

Limitation of liability

To the fullest extent permitted by law, Sanct OÜ will not be liable for any indirect, incidental, special, or consequential loss, or for lost data, profits, or goodwill, arising from your use of Hasp. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim, which for the free service is zero. Nothing in these terms limits liability that cannot be limited by law.

Termination

You may stop using Hasp at any time. We may suspend or end your access to the website or the relay if you break these terms or to protect the service. The sections that by their nature should survive, such as those on brand, warranty, and liability, continue to apply afterwards.

Governing law and disputes

These terms are governed by the laws of Estonia, without regard to its conflict of law rules. The courts of Estonia have jurisdiction over any dispute, unless mandatory consumer law in your country of residence gives you the right to bring a claim elsewhere.

Changes to these terms

We may update these terms as Hasp changes or the law requires. When we do, we will revise the date at the top of this page, and continuing to use Hasp after a change means you accept the updated terms.
